By accessing or using Outchat ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Outchat provides a web-based interface for accessing various AI language models including GPT-4, Claude, and Gemini. The Service allows users to have conversations with AI assistants for productivity, coding assistance, writing, and general information purposes.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscription Plans and Credits

Outchat offers the following plans:

• Free Plan: 50 credits per month, access to GPT-4o Mini
• Premium Plan: $15/month, 1,000 credits per month, access to all AI models

Credits are consumed based on actual token usage. Unused credits do not roll over to the next billing period. Credit consumption varies by model and message length.

5. Payment Terms

Premium subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, and access will continue until the end of your current billing period.

Refunds are provided at our discretion. We do not provide refunds for partial months or unused credits.

6. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or malicious content
• Harass, abuse, or harm others
• Violate intellectual property rights
• Attempt to bypass usage limits or security measures
• Use automated systems to access the Service without permission
• Generate spam, phishing content, or malware
• Impersonate others or misrepresent your affiliation

7. AI-Generated Content

Content generated by AI models through our Service is provided "as is." We do not guarantee the accuracy, completeness, or reliability of AI responses. You are responsible for reviewing and verifying any AI-generated content before use.

AI models are provided by third parties (OpenAI, Anthropic, Google, xAI). Their respective terms and usage policies also apply to content generated through their models.

8. Intellectual Property

You retain ownership of content you input into the Service. You grant us a limited license to process your inputs for the purpose of providing the Service. AI-generated outputs may be used by you for any lawful purpose, subject to third-party AI provider terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTCHAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. We will notify users of material changes via email or through the Service.

13. Governing Law

These terms are governed by the laws of the jurisdiction in which Outchat operates, without regard to conflict of law principles.
